District Court Sets Publish Date For All FSMA Rules

The Produce Safety Rule and Preventative Controls portions of the Food Safety Modernization Act (FSMA) were rolled out in January. The comment period has been extended through Sept. 16 for the Produce Safety Rule and the Preventative Controls Rule. There are several other pending portions of FSMA that have not been released yet for public comments.

These proposed regulations include foreign supplier verification, traceability, voluntary qualified importer program, and accreditation of third-party auditors.

The USDA must publish all proposed FSMA regulations by Nov. 30, according to a ruling by the U.S. District Court’s Northern District of California. District Judge Phyllis Hamilton recently ordered that the comment period for the proposed regulations will not close later than March 31, 2014. Final regulations will be published in the Federal Register by June 30, 2015.

“I remember FDA representatives at the FSMA public meetings and at other conferences I attended earlier this year stating that foreign supplier verification would be published ‘soon,’ so perhaps there will be some more FSMA activity in the coming months,” said Lee Mannering, Produce Marketing Association’s government relations and public affairs manager, on PMA’s Field To Fork blog.
